Court Opinion: Colorado Supreme Court Rules Only State Can Prosecute Dependency, Neglect Cases, Overruling 1986 Exception

The Colorado Supreme Court held that only the state has standing to prosecute dependency and neglect cases, rejecting a child’s attempt through counsel for youth to continue a case the state had moved to dismiss and overruling a 39-year-old precedent to the contrary.
