Trump administration seeks approval to end Haitian TPS

The Trump administration has asked the Supreme Court to allow it to move forward with revoking Temporary Protected Status for Haitian nationals while legal challenges continue. In an emergency filing, government lawyers urged the justices to lift a lower-court injunction that currently blocks the administration from ending the humanitarian protections.

The dispute arises from a lawsuit filed by Haitian TPS holders and advocacy organizations, who contend the administration’s decision to terminate the designation was unlawful. A federal district court previously issued an injunction preventing the government from carrying out the policy, finding the challengers had raised substantial legal concerns. The 4th Circuit Court of Appeals later declined to pause that ruling, allowing the injunction to remain in place.


In its Supreme Court filing, the administration argued federal courts improperly interfered with the executive branch’s authority to decide whether conditions in a foreign country justify continuing TPS protections. It asked the justices to step in and permit the government to implement the policy while the litigation proceeds.
