GreenLatinos, 350 Colorado, and Earthworks, Plaintiffs-Appellants, v. Colorado Air Quality Control Commission, Defendant-Appellee, and Colorado Oil and Gas Association, Intervenor-Defendant-Appellee. 2026 COA 74. As a matter of first impression, a division of the court of appeals considers whether the Colorado Air Quality Control Commission complied with the Colorado Air Pollution Prevention and Control Act, §§ 25-7-101 to -148, C.R.S. 2026, and the State Administrative Procedure Act, §§ 24-4-101 to -109, C.R.S. 2026, in adopting a rule that imposes enhanced air pollution monitoring
requirements for pollution sources in disproportionately impacted communities. The division concludes that the Commission acted reasonably and upholds the rule. Read the opinion.
