The Issue:
The number of people held in U.S. federal immigration detention is unprecedented. In January 2026 alone, Immigration and Customs Enforcement (ICE) detained 39,694 people. At the same time the federal government has ramped up enforcement actions, the agencies charged with administering immigration law have adopted a restrictive statutory interpretation, now finding that most people in immigration custody do not qualify for release. The sole mechanism to challenge unlawful detention and restore people’s liberty is through filing habeas petitions.
