Court upholds denial of additional liquor store licenses

The Colorado Court of Appeals has affirmed a state regulatory decision denying additional retail liquor store licenses to OnePutt Liquors, LLC, upholding the Colorado Department of Revenue’s interpretation of the state’s liquor licensing framework.

In OnePutt Liquors, LLC v. Colorado Department of Revenue, the court reviewed whether the agency properly applied statutory limits governing the issuance of retail liquor store licenses. OnePutt Liquors challenged the denial, arguing it should have been eligible for additional licenses under its reading of the Colorado Liquor Code.


The appellate court upheld the agency’s decision, concluding the applicable statutory provisions restrict the issuance of additional retail liquor store licenses under the circumstances presented. The panel determined the Department of Revenue acted within its authority in interpreting and enforcing those limits when it denied the application.

By affirming the ruling, the court left in place the agency’s determination and rejected the applicant’s request for additional licenses. The decision maintains the existing regulatory structure governing retail liquor store licensing in Colorado.
