District Attorney and candidate for Colorado Attorney General Michael Dougherty has joined prosecutors and local leaders from across the country in a national legal effort before the U.S. Supreme Court in Louisiana v. FDA.
The legal filing, submitted by the Public Rights Project on May 6, supports efforts to block a recent 5th U.S. Circuit Court of Appeals ruling that would significantly restrict access nationwide to the FDA-approved medication mifepristone, including access through mail and pharmacies.
“Decisions about safe, FDA-approved medications should be guided by science, medical expertise, and the law – not politics,” said Dougherty. “Efforts to restrict access to lawful medication undermine public trust and create unnecessary barriers for patients, particularly those in vulnerable or underserved communities.”
The filing includes 110 signatories representing 89 jurisdictions across 24 states, reflecting broad national concern about the potential consequences of the ruling. The coalition argues limiting access to mifepristone would disrupt established medical practice, strain public health systems and create confusion for providers and patients alike.
“As prosecutors, we are committed to upholding the law and protecting the well-being of our communities,” Dougherty added. “This effort reflects a shared commitment to ensuring that legal, evidence-based health care remains accessible and that courts respect long-standing regulatory authority.”
Mifepristone has been approved by the U.S. Food and Drug Administration for more than two decades and is widely used as part of a safe and effective medication regimen.
