Prosecutors in criminal cases have legal and ethical obligations to turn over all evidence to the defense, even evidence that might help the defense or undermine the prosecution’s own witnesses. This program surveys national research and selected national and Colorado court decisions to identify recurring issues reflected in discovery litigation and professional responsibility rulings. The program is designed for educational purposes: to clarify standards, summarize how courts analyze these issues, and provide a foundation for discussion.
